Any association \u2013 and association vendor or partner \u2013 that handles an EU resident\u2019s data must comply with these new standards, even if the association is not based in Europe. GDPR focuses on protecting personal data that is used by companies and organizations to conduct business and making information about how companies are using personal data more accessible and understandable to individuals. <\/span><\/p>\n<p><span style=\"font-weight: 400\">GDPR was approved by the EU Parliament on April 14, 2016 and goes into effect on May 25, 2018. Check out a brief history of the regulatory events and need for increased data regulation that led to the enactment of <\/span><a href=\"https:\/\/www.eugdpr.org\/how-did-we-get-here-.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">GDPR here<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Organizations that operate outside the rules of compliance after May 25 can face heavy fines: up to 4 percent of annual global turnover or 20 million, whoever is greater. <\/span><\/p>\n<h3><b>What is the most relevant information for associations?<\/b><\/h3>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-7894\" src=\"https:\/\/www.naylor.com\/associationadviser\/wp-content\/uploads\/sites\/2\/2018\/04\/How-GDPR-affects-association-operations.jpg\" alt=\"How GDPR affects association operations\" width=\"526\" height=\"536\" srcset=\"https:\/\/www.naylor.com\/associationadviser\/wp-content\/uploads\/sites\/2\/2018\/04\/How-GDPR-affects-association-operations.jpg 526w, https:\/\/www.naylor.com\/associationadviser\/wp-content\/uploads\/sites\/2\/2018\/04\/How-GDPR-affects-association-operations-294x300.jpg 294w\" sizes=\"(max-width: 526px) 100vw, 526px\" \/><\/p>\n<p><span style=\"font-weight: 400\">The regulations are quite detailed (88 pages long), but in short, there are a few areas of compliance most relevant to associations.<\/span><\/p>\n<h4><b>Consent.<\/b><\/h4>\n<p><span style=\"font-weight: 400\">Users need to provide consent (no automatic opt-in checkboxes) to email communications. <\/span><\/p>\n<h4><b>Right to Be Forg<\/b><b>otten. <\/b><\/h4>\n<p><span style=\"font-weight: 400\">Users have the right to erase their data and become obsolete within the system.<\/span><\/p>\n<h4><b>Right to Understand Data Held. <\/b><\/h4>\n<p><span style=\"font-weight: 400\">Users have the right to request an organization disclose the personal data it holds on them at no charge to the user.<\/span><\/p>\n<h4><b>Security and Privacy Management. <\/b><\/h4>\n<p><span style=\"font-weight: 400\">Organizations must have reasonable data protection measures to protect consumers\u2019 personal data and privacy against loss or exposure.<\/span><\/p>\n<h4><b>Data Breach Notification. <\/b><\/h4>\n<p><span style=\"font-weight: 400\">Organizations that process data (e.g. solution providers) must notify the controller of the data (e.g. associations) who then must notify a designated supervisory authority of a personal data breach within 72 hours of identifying the breach. Specific details of the breach such as the nature of it and the approximate number of subjects affected must be provided. Subjects must also be notified as quickly as possible when the breach places their rights and freedoms at high risk.<\/span><\/p>\n<p><span style=\"font-weight: 400\"><div class=\"boxshadow\"><div class=\"box-inner-block\"><i class=\"tieicon-boxicon\"><\/i>\n\t\t\tWondering if your association is in compliance?
